Bombay HC upholds ban on use of “The New Indian Express” outside agreed territories

By Staff Writer in Media News on
The Bombay High Court has upheld an interim order restraining Express Publications (Madurai) from using the “The New Indian Express” brand outside the territories permitted under settlement agreements within the Indian Express Group.  A division bench dismissed the appeal and upheld a single-judge order granting interim relief to The Indian Express.  The dispute arises from post-split arrangements following the death of founder Ramnath Goenka, governed by a 1995 Memorandum of Settlement and a 2005 agreement, which allow limited territorial use of “The New Indian Express”.  The case was triggered after an event titled “The New Indian Express – Mumbai Dialogues” was held in Mumbai, outside the permitted regions.  The court held that such use breaches the consent decree, may dilute the “Indian Express” trademark, and continued the interim restraint pending the main suit. &n
